The Civil Rights and Title IX Coordinator is responsible for ensuringUSCUpstate's monitoring and compliance with federal and state laws, policies, and procedures relating to discrimination/harassment involving age, race, color, sex, gender, sexual orientation, gender identity, gender expression, national origin, religion, disability, protected veteran status and other protected classifications. Specifically, the Civil Rights and Title IX Coordinator has primary responsibility for enforcingUSCUpstate's non-discrimination policies; ensuring compliance with Title VI of the Civil Rights Act of 1964, TitleVIIof the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, relevant provisions of the Clery Act, as amended by the Violence Against Women Reauthorization Act of 2013 (VAWA), the Americans with Disability Act (ADA), Section 504 of the Rehabilitation Act of 1973, the Age Discrimination Act of 1975, and other federal and state laws and regulations pertaining to equal rights and nondiscrimination (Nondiscrimination Laws). This role oversees and coordinates investigations including delivery of supportive measures, responses, and resolutions to complaints.

Policy Management and Compliance

  • Develop, create, implement, and oversee appropriate university discrimination and harassment policies, procedures, and practices to ensure equitable access to education programs and activities.
  • Work collaboratively with other university departments on the development and review of related university policies and procedures. Conduct annual policy audits and reviews.
  • Develop annual reports for civil rights and interpersonal violence complaints, investigations, and resolutions. Produce appropriate reports and present outcomes to senior leadership.
  • Coordinate regulatory and other legal responses with appropriate university departments.
  • Remain current on national trends and best practices.
  • Maintain knowledge through active professional development.

Coordination of Reports and Complaints

  • Provide consultative guidance to all university offices on their obligations and responsibilities under university policies related federal and state laws or regulations.
  • Collaborate with university and departmental administration to coordinate education on reporting, investigation procedures, and compliance within respective units.
  • Effectively communicate with key stakeholders and law enforcement entities to ensure the needs of the university community are addressed.
  • Objectively and effectively oversee and coordinate investigations of allegations of interpersonal violence ensuring investigations are timely, impartial, equitable, and thorough.
  • Provide information to the university community about reporting options, processes, rights, and resources available to those involved in the investigation process.
  • Maintain and oversee case management systems. Track cases, data, and trends to identify and address patterns and systemic concerns. Collaborate with university partners, as appropriate, on the implementation of initiatives to address identified patterns and concerns.
  • Works with the Office of General Counsel in responding to complaints of discrimination filed with the federal and state administrative agencies.

Case Management and Resolution

Oversees both the investigative and resolutions processes, including formal and informal, and any cases moving through those processes. Oversees the case assignments to the investigators, which includes considering individual caseload and the complexity of each case. Support investigations and informal resolutions as needed. May develop a risk rating scale to assist with evaluating the complexity and risk of individual cases. Ensure investigative steps and associated documentation are documented in the Maxien case management system, in alignment with policies and procedures and expectations. Provide periodic and timely updates regarding the status of ongoing cases to the supervisor, Continuum of Care team, and other stakeholders, as necessary. Track any compliance or general trends in case management and suggest solutions to any isolated or systemic issues.

Develops and prepares all documentation related to the resolutions processes, including but not limited to notice of hearing, decisions, and outcome letters.). Maintains required documentation in the Maxient database. Ensure documentation aligns with best practices and requirements as outlined in laws and regulations.
