Minimum Qualifications Minimum Qualifications:Transfers: One year of permanent competitive or 55b/c service in this title or in a title eligible for 70.1 or 52.6 transfer.Open to the Public: This title is part of the New York Hiring for Emergency Limited Placement Statewide program (NY HELPS). For the duration of the NY HELPS Program, this title may be filled via a non-competitive appointment, if the candidate meets the below NY HELPS minimum qualifications.NY HELPS Non-Competitive Minimum Qualifications:Position may be filled at the Senior Attorney level or one of the Assistant Attorney traineeship appointment levels. Appointment title will be dependent upon qualifications of candidate selected.Assistant Attorney 1 (Grade 18): Law school graduation and/or eligibility for NYS Bar Admission.Assistant Attorney 2 (Grade 20): Admission to NYS BarAssistant Attorney 3 (Grade 22): 12 months as an Assistant Attorney 2, or Admission to the NYS Bar and 12 months of subsequent satisfactory legal experienceSenior Attorney (Grade 25): 12 months as an Assistant Attorney 3, or Admission to the NYS Bar and 24 months of subsequent satisfactory legal experienceNOTE: Admission to the New York State Bar and current registration to practice law in New York State is required for continued employment. Disbarment or loss of registration shall result in termination or suspension of employment.This position may be designated 55 b/c and is subject to verification of applicant eligibility.Preferred Qualifications: The candidates for these positions need to have strong legal and organizational skills; possess excellent oral and written communication skills; be able to work in a fast-paced legal environment; and be able to work as a member of a team. It would be very desirable if the candidates had criminal or civil trial experience or administrative hearing experience. Duties Description "These positions are assigned to the Bureau of Professional Medical Conduct in the Department of Health’s Division of Legal Affairs. The Bureau of Professional Medical Conduct prosecutes physicians, physician assistants and other licensees for professional misconduct. Attorneys in the Bureau work closely with staff from the Office of Professional Medical Conduct. The candidates would be expected to:1. Represent the Department in administrative hearings related to the prosecution of physicians, physician assistants and other licensees for professional misconduct.2. Draft appeal briefs in matters before the Administrative Review Board.3. Prepare Statements of Charges, Notices of Hearing, Subpoenas, Post-hearing submissions, and other legal documents.4. Review Investigative materials, interview and prepare lay and expert witnesses for hearings, and analyze and develop evidence for proceedings and disciplinary hearings.5. Draft and negotiate Consent Agreements, Surrenders, Non-Disciplinary Orders, Summary Suspensions, and other documents related to case resolution.6. Conduct legal research and draft legal memoranda.7. Provide legal and practical advice and recommendations to OPMC executive, investigative, and administrative staff.8. Prioritize cases, manage caseload, and promptly document entries in Hearing Tracker9. Interact with staff from other Federal, State and City governmental agencies."

Additional Comments "The Senior Attorney/Traineeship titles are part of the NYS HELPS program. For the duration of the HELPS Program, these titles may be filled via permanent non-competitive appointment, which means no examination is required but all candidates must meet the minimum qualifications of the titles for which they apply. At a later date (usually within a year of appointment), employees hired under the HELPS Program will have their non-competitive employment status converted to competitive status. Employees will then be afforded with all of the same rights and privileges of competitive class employees of New York State.Depending on how the candidates qualifies, the positions could be filled as competitive or non-competitive.
