Minimum Qualifications MINIMUM QUALIFICATIONS:NY HELPS This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS). For the duration of the NY HELPS Program, this title maybe filled via a non-competitive appointment, which means no examination is required but all candidates must meet the minimum qualifications of the title for which they apply. At this time, agencies may recruit and hire employees by making temporary appointments. In June 2024, if a temporary NY HELPS employee is satisfactorily performing in the position, the appointment will be changed from temporary pending Civil Service Commission Action to permanent non-competitive and the official probationary period will begin. At a future date (within one year of permanent appointment), it is expected employees hired under NY HELPS will have their non-competitive employment status converted to competitive status, without having to compete in an examination. Employees will then be afforded with all of the same rights and privileges of competitive class employees of New York State. While serving permanently in a NY HELPS title, employees may take part in any promotion examination for which they are qualified.NON-COMPETITIVE MINIMUM QUALIFICATIONS: To be considered for appointment through NY HELPS, or 55 b/c, candidates must meet the open-competitive minimum qualifications for this position. Duties Description The New York State Education Department’s (NYSED) is seeking candidates for a Senior Attorney position in the Office of Counsel. Duties of this position include, but are not limited to, the following:Provide legal advice and counsel to one or more of the Department’s program offices and assist in the drafting and review of Department regulations and guidance;• Perform necessary research and draft proposed decisions in appeals of actions or decisions of local school district officials brought to the Commissioner for resolution under Education Law §306 and §310 and other related appeal processes, including but not limited to Freedom of Information Law (FOIL) appeals, and assist in the review of such proposed decisions;• Provide effective and necessary assistance to the Attorney General (AG) in litigation handled by the AG and provide effective representation in litigation and administrative proceedings handled by the Department’s Office of Counsel;• Respond to and/or coordinate responses to subpoenas, as assigned;• Review and prepare recommendations on complex legislative proposals developed both within and outside of the Department;• Perform a variety of legal services, with minimal supervision, including legal research, preparing legal briefs, negotiating, and preparing legal documents and similar functions; and• Handle special assignments as requested by the Counsel or management team.

Promotions and transfers may change appointees’ negotiating unit. Candidates should be aware that changes in negotiating units may affect their salary, insurance, and other benefits. Verification of degree, New York State Bar admission status, and work experience will be required at the time of interview for all candidates. Candidates who are applying to Senior Attorney, SG-25 are required to possess admission to the New York State Bar at the time of hire. Continued employment as a Senior Attorney, SG-25 is dependent upon maintaining admission to the New York State Bar. Failure to maintain admission to the New York State Bar will result in removal from employment from applicable titles. This position may be filled as a traineeship. The starting salaries for this position are outlined below. For current New York State employees, salary is based on the candidate’s salary at the time of hire. Candidates appointed at the trainee level will be required to successfully complete the traineeship to advance to the full performance level title and salary. • $65,001(Assistant Attorney 1/Trainee 1- NS equated to SG-18)• $72,032 (Assistant Attorney 2/Trainee 2- NS equated to SG-20)• $79,928 (Assistant Attorney 3/Trainee 3- NS equated to SG-22)• $93,530 (Senior Attorney/Full Performance level SG-25)This position leads to a maximum salary of $117,875 based on annual performance advances.
